Box 2009 <br /> Stockton, CA 95201 <br /> SUBJECT: Ryder Truck Rental, 1700 North Broadway, Stockton, California 95205 <br /> Dear Ms. Cotulla: <br /> This letter is prepared in response to your July 19, 1991 correspondence with regard to <br /> Environmental Science & Engineering, Inc.'s (ESE) report of site work conducted at the <br /> subject facility. <br /> Prior to commencement of our subsurface investigation of the subject facility, ESE <br /> contacted Ms. Diane Hinson of San Joaquin County Public Health Services (County) to <br /> determine permit requirements for the subsurface investigation. At this time, Ms. Hinson <br /> explained that the County had no authority to provide local oversight of an above-ground <br /> storage tank spill and that permits for this work would not be issued without regulatory <br /> oversight of this work. ESE contacted Ms. Antonia Vorster of the Central Valley Regional <br /> Water Quality Control Board (RWQCB) to request project oversight. Ms. Vorster <br /> explained further that at this time, the RWQCB and the County were in the process of <br /> developing a mechanism to facilitate the issuance of permits for sites where no regulatory <br /> oversight is available. <br /> Based on this conversation, it was ESE's conclusion that no expedient mechanism existed <br /> for the review and issuance of permits for this investigation. Ryder Truck Rental, the <br /> lessor of the property, had an immediate obligation to the property owner to mitigate the <br /> effects of the above ground tank spill. For these reasons, the site work was performed <br /> without permits. <br /> It is ESE's strict policy on all projects to obtain all required permits prior to <br /> commencement of site work.
