Michael Oliphant - 2 - 18 April 2012 <br /> NFAR — Catellus, Tracy <br /> Central Valley Water Board staff received the 12 October 2011 Soil and Groundwater Management <br /> Plan (SGMP) that provides guidance for whoever may conduct future excavation and/or maintenance <br /> activities at the Site. The SGMP, which designates Chevron as the responsible party for any issues <br /> that arise confirmed to be related to the crude oil leaks, was submitted to owners of property overlying <br /> affected soil and/or groundwater. <br /> On 13 February 2012, Central Valley Water Board staff notified owner(s) of property determined to <br /> overlie the affected area(s) and owner(s) of property within a 2D0-foot radius of the approximate <br /> boundary of the affected soil and/or groundwater by certified mail, of Chevron's request for NFAR <br /> determination. A representative for one nearby property owner provided written comments that stated <br /> their understanding that Chevron is responsible for addressing residual crude oil impacts from the Site <br /> that could potentially be identified in the future. <br /> Provided the information submitted to this agency was accurate and representative, no further action is <br /> needed at the Site. If existing, additional, or previously unidentified chemical constituents confirmed to <br /> be associated with the former crude oil pipelines at the Site cause or threaten to cause pollution or <br /> nuisance, or are found to pose a threat to public health or water quality, then: 1) nothing in this <br /> determination is intended or shall be construed to limit or preclude the Central Valley Water Board or <br /> any other agency from taking enforcement action, and 2) this letter does not relieve Chevron of any <br /> responsibilities mandated under the California Health and Safety Code or the California Water Code. <br /> Any person aggrieved by this action may petition the State Water Board to review the action in <br /> accordance with Water Code section 13320 and California Code of Regulations, title 23, sections 2050 <br /> and following. The State Water Board must receive the petition by 5:00 p. m., 30 days after the date of <br /> this action, except that if the thirtieth day following the date of this action falls on a Saturday, Sunday, or <br /> State holiday, the petition must be received by the State Water Board by 5:p.m. on the next business <br /> day.
