Box 388 <br /> Stockton, CA 95201 <br /> Site Code 1038 <br /> Subject: Your Letter of September 11, 2000 to Michael D. & Sharon Olivarez <br /> Dear Ms. Oz: <br /> Please be advised that your letter of September 11,2000 was received by both the addressee and this <br /> consultant on the September 12, 2000. The property owner and this consultant are making every <br /> effort to meet your demanding work schedule on this project. To date the Michael and Sharon <br /> Olivarez have spent more than$80,000 on the investigation of this site and the quarterly samples for <br /> the site monitoring wells were sampled on August 30, 2000. The work on this site is being pursued <br /> at a rate that man power and financial resources will allow. <br /> As you know,the offsite investigation work was started with CPT#3 located in the Caltrans R/W.On <br /> May 3, 2000, an attempt was made to install a monitoring well in the sidewalk on the north side of <br /> Lafayette Street. This attempt was met with the discovery of an unknown steel underground storage <br /> tank (UST) directly under the proposed monitoring well location at a depth of five feet. After the <br /> Stockton Fire Department,the City of Stockton inspector and yourself left the site the bore hole was <br /> bridged and concrete was placed to the finish grade of the sidewalk(See attached site map). <br /> Due to the extreme safety hazard and the potential liability to all parties concerned, it is <br /> recommended that no further work be performed in this area until the USTs are removed. The local <br /> agencies should meet to determine who is responsible for this UST and other unknown USTs. Until <br /> the area is cleared of known and unknown hazards presented by the UST, it is not in the best interest <br /> of Michael and Sharon Olivarez to obtain an encroachment permit from the City of Stockton for the <br /> sidewalk area on the north side of Lafayette Street. <br /> As for the well receptor survey,California Water Service Co.has abandoned its only domestic water <br /> well within 2000 feet of the site. This consultant has not completed a full surface investigation for <br /> water wells or a review of the Department of Water Resources data on existing wells within a 2000' <br /> radius of the site. This receptor survey should be completed by the end of September and the results <br /> issued with the third quarter report of monitoring wells. <br /> Page 1 of 2 <br />
