R UST LUFT LETTER Page 2 Before receiving a PHS/EHD corrective action directive and in order to receive the SWRCB Clean up Fund Letter of Commitment, you must make application to the State of California Water Resources Control Board' s (SWRCB) "Petroleum Underground Storage Tank Cleanup Fund" (Fund) An application package for the Fund has been provided. The Fund was created pursuant to Chapter 6.75 of the California Health and Safety Code to help eligible owners and operators of petroleum underground storage tanks to: 1. Meet federal requirements to demonstrate financial responsibility; 2 . Obtain reimbursement for costs of the cleanup of unauthorized releases of petroleum from USTs; and 3 . Obtain reimbursement for damages awarded to third parties who are injured by petroleum releases. The maximum amount available from the Fund is $990, 000 per occurrence. Claimants are responsible for the first $10,0(0 of eligible costs. Applications must be submitted to the SWRCS Clean Up Fund to undergo eligibility ranking for funding in the 1995-9E state fiscal budget year. All subsurface investigations and remedial actions must be performed under a workplan approved by PHS/MM. The Fund does not cover the costs incurred for the removal, repair, retrofit, or installation of USTs.
