are no closer to fullfilling any of the EHD requirements/conditions of THAT approval.
Until BOTH site's systems are back up and running, ConocoPhillips is to provide updates
to each site on a monthly basis. Include a rough schedule of dates work to complete
system return are anticipated. The report/updates are due on Geotracker by the last
working day of the month. Anticipate the delay time of 2-3 days from your upload time to
availability for regulatory viewing. For my review on April 29, 1 suggest you ensure your
updates/documents are uploaded NLT April 26.
as for CP #5449, due to the extreme delays to re-install/replace the wells and get the
remediation system back on line, the EHD has required of COP/Stantec monthly updates
and a schedule also at the end of EACH month until advised by me not to continue
submitting. This requirement remains.
additionally, a work plan is needed for the well reinstalls at this site. Get it uploaded to
Geotracker very very soon. I will review the plan and advise of any changes needed. A
permit and a Master File Record form will then be required before these wells can be
installed. If the 'recovery' of the three wells is NOT conducted at the same time the
replacement wells are installed, a separate permit is required to recover and bring the
protected wells back online. The work plan due should clearly explain your plans, times
this work will conducted.
the April 2011 status letter for this site is due on Geotracker for my review on April 29.
again, anticipate upload delay.
Mike
From: Ben Chevlen [mailto:ben.chevlen@atcassociates.com]
Sent: Tuesday, April 12, 2011 11:02 AM cO
To: Mike Infurna [EH]
Cc: 'Ralston, Ed C.:'
Subject: Site Remediation Status Update: Circle K Store No. 1205 - Lathrop and 76 Service Station
No. 11192 - Stockton
Importance: High
Mike— I wanted to let you know that ATC is taking over the role of lead consultant for the above-
referenced sites;a formal notification letter will be issued shortly. Please note that Stantec was
operating remediation systems at the two sites, and those systems may need to be temporarily
,shut-down until ATC is permitted to operate the equipment. ATC is in the process of determining if
the remedial system operation permits were issued in a manner that will allow ATC to operate the
equipment, or if modifications to the permits will be required (a request to modify the permit for
the SVE system installed at the Lathrop site has already been submitted). While it is
understandable that the SJCEHD would want to keep the equipment operating, please understand
that it is also in both ConocoPhillips' and ATC's interest to have the equipment operating, while
remaining in compliance with all regulatory agency and permit requirements.
Please feel free to contact me to discuss the matter further; if the SJCEHD has an issue with the
4/12/2011
