Advanced � <br /> GeoEnNriron rental , Inc . <br /> 31 May 2001 JUN 0 6 2001 <br /> AGE-NC Project No. 96-0232 <br /> ENVIRONMENT HEALTH <br /> PERMIT/SERVICES <br /> Mr. Marty Hartzell <br /> CENTRAL VALLEY REGIONAL WATER QUALITY CONTROL BOARD <br /> 3443 Routier Road, Suite A <br /> Sacramento, CA 95827-3003 <br /> Subject: First Quarter Update on Annexation to Community Service Area No. 31 <br /> Rocky's Restaurant- 14659 Thornton Road,Lodi, California <br /> CVRWQCB Cleanup and Abatement Order No. 5-00-700 <br /> Dear Mr. Hartzell: <br /> Enclosed,please find the letter First Quarter Update on Annexation to Community Service Area No. <br /> 31,dated 29 May 2601,prepared by Rishwain&Rishwain,attorneys for the Bokides Family Limited <br /> Partnership (BFLP). <br /> As discussed in the aforementioned letter,the most feasible alternative is to wait for a third party to <br /> post the necessary bond for the expansion of the treatment plant; the BFLP does not have bonding <br /> capabilities. <br /> As to our prior conversations regarding the possibility of purchasing excess capacity for the Rocky's <br /> site, it appears that the usage by the restaurant,calculated at 3,000 gallons per day,would require the <br /> purchase of approximately 1.5 acres of excess capacity. The cost for the purchase, estimated at <br /> $75,000,would not make it cost effective to purchase excess capacity at this time versus the ongoing <br /> costs of supplying bottled water to Rocky's. <br /> BFLP is hopeful that within 6 months a third party developer will be posting the necessary bonds <br /> that will provide for expansion of the treatment plant, thus allowing Rocky's to be fully annexed into <br /> Community Service Area No. 31. The BFLP will therefore be submitting costs for the annexation <br /> and required utility connections to the Underground Storage Tank Cleanup Fund(USTCF) for pre- <br /> approval. This will allow the BFLP to move quickly once a bond has been posted.
