We find you in <br /> violation of Orders No. 4 and 6 of C&A Order No. 5-00-700. <br /> C&A Order No. 5-00-700, Order No. 4 requires you to submit an update in each quarterly report <br /> discussing progress to provide a permanent water source for Rocky's Restaurant well that is impacted <br /> with MtBE from Flag City Chevron groundwater contamination. The QMR did not include the required <br /> progress update, and failure to submit this update is a violation of C&A Order No. 5-00-700. A Notice of <br /> Violation(NOV) was issued to Flag City Chevron on 5 February 2001 for failure to submit updates in the <br /> Third and Forth Quarter 2001 Quarterly Monitoring Reports as required in C&A Order No. 5-00-700, <br /> Order No. 4. On 15 February 2001, you submitted the required update for the Third Quarter and Forth <br /> Quarter 2001 monitoring periods; however, you have not shown a good faith effort to continue the <br /> required reporting. <br /> C&A Order No. 5-00-700, Order No. 6 requires you to sample and analyze groundwater from on-site and <br /> off-site monitoring wells,the Rocky's and Three B's domestic wells and the two County Service Area <br /> (CSA) wells, formerly referred to as the Flag City Wells. The CSA wells were not sampled as required in <br /> the first quarter of 2001, and failure to sample and report results from CSA wells is a violation of C&A <br /> Order No. 5-00-700. Board staff discussed this issue with AGE staff on 14 May 2001. AGE stated that <br /> they made three attempts to sample the CSA wells in March 2001, and that San Joaquin County personnel <br /> did not show up to allow access to the wells. As of 14 May 2001, the wells had not been sampled. Board <br /> staff requested that the two wells be sampled as soon as possible. Board staff spoke with Mr. Ben <br /> Guzman from the San Joaquin County Municipal Utilities on 22 May 2001, and Mr. Guzman stated that <br /> Flag City Chevron sampled the CSA wells during the week of 14 May 2001. <br /> California Environmental Protection Agency <br /> C,* Recycled Paper <br /> The energy challenge facing California is real.
