i <br /> Advanced <br /> GeoEnvironmental, Inc <br /> �K <br /> 13 February 2001 <br /> AGE-NC Project No. 96-0232 <br /> Mr. Marty Hartzell <br /> CENTRAL VALLEY REGIONAL WATER QUALITY CONTROL BOARD <br /> 3443 Routier Road, Suite A <br /> Sacramento, CA 95827-3003 <br /> Subject: Fourth Quarter Update on Annexation to Community Service Area No. 31 <br /> Rocky's Restaurant- 14659 Thornton Road, Lodi, California <br /> CVRWQCB Cleanup and Abatement Order No. 5-00-700 <br /> Dear Mr. Hartzell: <br /> Enclosed,please find the letter Fourth Quarter Update on Annexation to Community Service Area <br /> No. 31, dated 31 January 2001,prepared by Rishwain&Rishwain, attorneys for the Bokides Family <br /> Limited Partnership (BFLP). <br /> As discussed in the aforementioned letter,Rocky's Restaurant has received conditional approval for <br /> annexation into the Community Service Area No. 31 by LAFCO. However,because of the lack of - <br /> capacity,full annexation into the service area will not be possible until: 1)BFLP can purchase excess <br /> capacity from an existing owner; or 2) BFLP posts a$620,000 bond for the ultimate expansion to <br /> the service area; or 3) another landowner posts the aforementioned bond. <br /> Based upon an analysis of annexation costs prepared by Rishwain & Rishwain (page 3 of the <br /> attached letter), it may be cost-effective to purchase capacity from an existing landowner, as <br /> compared to posting a bond or waiting for another landowner to post a bond. The potential cost- <br /> effectiveness of a capacity purchase is based upon the present operating costs of the required <br /> drinking water system at Rocky's Restaurant and costs for hook-up fees in the event a bond is <br /> posted. The attached letter discusses some of the potential hook-up costs. <br /> AGE is presently performing a detailed analysis of the potential cost-effectiveness of the capacity <br /> purchase option versus other available options.
