Both the Third and the Fourth QMRs
did not include the required progress update, and failure to submit this update is a violation of C&A
Order No. 5-00-700.
As required in C&A Order No. 5-00-700, you submitted a plan to provide a permanent alternative water
source for Rocky's Restaurant to our office on 15 March 2000. In this plan, you estimated that Rocky's
Restaurant property would be annexed into the community service area, and connected to the Flag City
water system by 15 September 2000. An update in your 19 July 2000 Quarterly Report—Second
Quarter 2000 stated that the proposed annexation should be approved in July 2000;however, it did not
state if the 15 September 2000 date would be met. In our letter dated 17 August 2000 (attached), we
requested that you submit a monthly update on the work completed to provide a permanent water source
for Rocky's Restaurant until a permanent water source is supplied. To date,we received only one update
letter by facsimile on 2 October 2000.
Therefore, you must immediately submit past due quarterly updates, which document all activities past,
current, and proposed, with associated milestones, that have been/will be conducted to provide the
required permanent alternative water source to Rocky's Restaurant. If the required updates are not
received by 15 February 2001,we will proceed with formal enforcement action, which may include fines.
California Environmental Protection Agency t d,a
Qa Recycled Paper
The energy challenge facing California is real.
