CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> CLEANUP AND ABATEMENT ORDER NO 5-00-700 <br /> FOR <br /> FLAG CITY LIMITED PARTNERSHIP <br /> MR RICHARD BOKIDES <br /> BOKIDES FAMILY LIMITED PARTNERSHIP <br /> FIRST INVESTMENT FLAG CITY, INCORPORATED <br /> FLAG CITY CHEVRON <br /> FORMER SADDLE CITY CHEVRON <br /> AT <br /> 6421 CAPITOL AVENUE, LODI, SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region (hereafter Board) finds <br /> that <br /> 1 The Flag City Chevron at 6421 Capitol Avenue in Lodi has operated as a gasoline dispensing <br /> facility from 1984 to the present Prior to September 1994, the Flag City Chevron was named <br /> . Saddle City Chevron 490302 Mr Richard Bokides operated the facility from 1984 to 1997, and <br /> the First Investment Flag City, Incorporated has operated the facility from 1997 to present Other <br /> parties owned the facility, however those parties whose involvement in the site predates the <br /> earliest estimate of petroleum releases are not named in this Cleanup and Abatement Order The <br /> Amador Corporation owned the facility in 1993, and sold it to the Flag City Limited Partnership <br /> in early 1994 The Flag City Limited Partnership sold the facility to Mr Richard Bokides domg <br /> business as the Bokides Family Limited Partnership in September 1994 An indemnification <br /> agreement exists between the Flag City Limited Partnership and the Bokides Family Limited <br /> Partnership regarding hydrocarbon contamination at the site, and the Bokides Family Limited <br /> Partnership has accepted responsibility for site cleanup of contamination The Board is not a <br /> party to this private indemnification agreement, and the private indemnification agreement is not <br /> binding on the Board The Flag City Limited Partnership, Mr Richard Bokides, the Bokides <br /> Family Limited Partnership, the First Investment Flag City, Incorporated, Flag City Chevron, and <br /> the Former Saddle City Chevron, are hereafter collectively referred to as Discharger <br /> 2 On 7 May 1993,the San Joaquin County Environmental Health Division (County) identified soil <br /> contamination at the subject site during the installation of a tank-venting system The County <br /> notified the Discharger of the requirement to investigate the extent of contamination The Board <br /> received a notification of an Unauthorized Release from the Countt7 on 12 May 1993 <br /> 3 On 31 March 1995, five underground storage tanks (USTs) were removed and replaced at the <br /> site Groundwater was encountered approximately 8 feet below ground surface (bgs) in the <br /> excavations Soil and groundwater samples were collected from the excavation and submitted <br /> • for analysis of petroleum hydrocarbons Maximum concentrations of soil and groundwater <br /> contamination are presented in the table below <br /> California Environmental Protection Agencj <br /> �I Recycled Paper <br />
