Your letter suggests, and ux have
been advised through other channels, that your agency is concerned about
the impact of recent legislative changes on the department's ability to
oversee the project.
We want to take this opportunity to advise you of our willingness to meet
and negotiate amendments in the Existing Settlement Agreement between Marley
and the State agencies which would incorporate changes brought about by recent
legislation as well as changes necessitated by schedule developments and
interim agreements reached between the parties since the date of the original
agreement. While we have the utmost respect for the EPA's ability to oversee
the mitigation efforts, we feel the knowledge and specific experience with
the Marley site already gained by the California agencies will lead to the
quickest and most cost effective solution to the environmental concerns at
Stockton.
We will certainly make ourselves available to review the agreement and recent
legislation with agency representatives at your convenience.
Sincerely,
42ZJ4t
CC: Marvin Young/U.S. EPA
Gary Reents/Water Quality Board MARLEY
Laura Cotulla/San Joaquin Leal Health Dist/Stockton✓
the
Tim Ver? fieri
t' /TMC COOLING
TOWER
Larry Schaper/B&V company
Dave Bates/TMCfC
