CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> ORDER N0. <br /> NPDES NO. CA0081787 <br /> MODIFICATION OF ORDER NO. 88-124 <br /> WASTE DISCHARGE REQUIREMENTS <br /> FOR <br /> THE MARLEY COOLING TOWER COMPANY <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region, <br /> (hereafter Board) finds that: <br /> 1. The Marley Cooling Tower Company (hereafter Discharger) is permitted to <br /> discharge treated stormwater and treated ground water under Order No. 88- <br /> 124, National Pollutant Discharge Elimination System (NPDES) CAO081787, <br /> adopted by the Board on 24 June 1988. <br /> 2. The Discharger has been operating an interim groundwater treatment <br /> system since October 1987. <br /> 3. The Discharger is presently permitted to discharge up to 0.37 million <br /> gallons per day (mgd) of treated stormwater and/or ground water to the <br /> Stockton Diverting Canal , tributary to the Calaveras River, at a point <br /> approximately 1/4 mile east of the site in Section 32, T2N, R7E, MDB&M, <br /> as shown on Attachment A, incorporated herein and made part of this <br /> Order. <br /> 4. A Report of Waste Discharge (RWO) , dated 18 August 1990, was submitted by <br /> the Discharger and requested a modification to the existing NPDES permit, <br /> pursuant to Provision E. 10 of Order No. 88-124. This provision requires <br /> the Discharger to submit a new Report of Waste Discharge in the event the <br /> ongoing pollution studies indicate that significant changes in the <br /> facility operations are necessary. <br /> 5. This Order is a modification to the NPDES permit CA0081787 (Board Order <br /> No. 88-124) , pursuant to Section 402 of the Clean Water Act, and /] <br /> amendments thereto. <br /> 6. The Discharger owns a cooling tower fabrication plant in the East <br /> Stockton Area in San Joaquin County. As part of the fabrication <br /> operations, the Discharger operates a wood preservation process utilizing <br /> solutions containing copper and chromium. In the past, arsenic was also <br /> used in the wood preservation solutions. <br /> 7. The past use of the wood preservation solutions has resulted in <br /> contamination of soils and ground water underlying the site. The <br />
