Landis, P.E. <br /> Chief, Site Mitigation Branch <br /> Ref : Notice of Proposed Determination of Non-Compliance <br /> The Marley Cooling Tower Company <br /> Gentlemen: <br /> This will acknowledge receipt, on November 25 , 1991, of your <br /> November- 20 , 1991 letter concerning the schedule for completion <br /> of the groundwater collection system. <br /> As we understand your letter, the Department has extended the <br /> schedule for completion of the groundwater collection system <br /> through December 30 , 1991 . If Marley does not complete <br /> construction by that date, the Department is reserving its <br /> right to seek administrative penalties for the delay in <br /> completion. <br /> I assume that Acts of God or other events, clearly beyond the <br /> control of Marley, will be taken into account in making any <br /> determination in this regard. <br /> At the present time, Marley expects to comply with the December <br /> 30, 1991 date provided for in your letter.
