The groundwater collection system completion date was <br /> extended due to unforeseen delivery problems with key <br /> pumps and precast concrete vaults. <br /> 2 . The groundwater collection system design completion <br /> date was extended because unanticipated additional <br /> work was necessary to ensure coordination of control <br /> systems. <br /> 3 . The treatment plant expansion completion date was <br /> extended because unanticipated additional work was <br /> necessary to complete the accumulation and evaluation <br /> of operating data and experience from the pilot <br /> plant. This, in turn, has led to a more <br /> comprehensive system of automation and "fail-safe" <br /> features being incorporated into the new design. <br /> (For example, the sizes of specific system <br /> components, such as the solids handling system, have <br /> increased to provide a safety margin over our <br /> original design) . <br /> 4. Further adding to the extension of the treatment <br /> plant completion date was the unanticipated <br /> lead-times associated with the fabrication and <br /> shipment of certain equipment necessary for plant <br /> operation. <br /> Given the scope and complexity of the water treatment remedy, <br /> and the eight year history to this project, the additional ten <br /> weeks requested for full completion of the upgrade in the <br /> pumping capacity is reasonable and warranted. Additionally, in <br /> light of the projected thirty year life to the pumping program, <br /> it is very important that Marley and the Department not take <br /> any shortcuts that might jeopardize system integrity solely for <br /> the sake of meeting a schedule that was estimated over a year <br /> ago. <br /> If you desire any documentation of the reasons for the delay <br /> described above, Marley will be happy to provide it to you. <br /> Like you, Marley does not desire to go into the dispute <br /> resolution process, as such action only impedes our joint <br /> progress on this project. <br /> Your early response to this request for reconsideration will be <br /> appreciated. In the meantime, Marley will continue to exert <br /> its best efforts to expedite the completion of the full <br /> groundwater pump and treatment system as soon as possible. <br /> Sincerely, <br />
