Wagner Avenue PEP'' <br /> Stockton, CA 95215 <br /> MARLEYSYSTEM MODIFICA TION REPORT, FORMER MARLEY COOLING TOWER <br /> COMPANYFACILITY, STOCKTON, SANJOAQUIN COUNTY <br /> We have reviewed the Marley System Modification Report(Report) dated 3 December 2002 prepared by <br /> Latham and Watkins Attorneys at Law for the former Marley Cooling Tower Company facility in <br /> Stockton (Marley). The Report was submitted to the Regional Water Quality Control Board and the <br /> Department of Toxic Substances Control (DTSC) to satisfy a condition in DTSC's letter dated 4 <br /> November 2002 approving re-start of the Electro Chemical Precipitation System (ECS). The purpose of <br /> this Report is to provide (a) documentation of events of the 17 September 2002 system malfunction and <br /> fish kill in the Stockton Diverting Canal, (b) an analysis of corrective measures to prevent future <br /> unauthorized releases, and (c)proposed modifications to the ECS and Ion Exchange (IX) systems to <br /> prevent future unauthorized releases. <br /> We have had several discussions with DTSC staff regarding the subject Report. DTSC has provided <br /> comments on the Report to Marley in a letter dated 7 January 2003.
