Legal Description of Facility: <br /> Assessor's Parcel Number(APN): 163-37-018 <br /> 13.Findings: <br /> a. This permit is consistent with the standards adopted by the California Department of Resources Recycling and Recovery <br /> (CalRecycle)as required by 14 CCR,Division 7,Chapter 6. <br /> b. The design and operation of the facility is consistent with the Waste Tire Storage and Disposal Standards applicable to a major <br /> waste tire facility,pursuant to Public Resources Code(PRC)Section 42820 et.seq.and implementing regulations found in 14 <br /> CCR,Division 7,Chapter 3. <br /> c. The facility is located within a General Industrial zone and is consistent with the City of Stockton local zoning designation and <br /> General Plan(State Clearinghouse(SCH)#2004082066). It is determined that the project is statutorily exempt by PRC <br /> Section 21083.3(b). The Stockton General Plan 2035 Environmental Impact Report(EIR)describes and supports the design <br /> and operation which will be authorized by the issuance of this permit. The City of Stockton Community Development <br /> Department approved Use Permit P15-158 on May 20,2015 and determined the project is categorically exempt pursuant to 14 <br /> CCR Section 15301. A Notice of Exemption will be filed by CalRecycle with the SCH upon issuance of this permit. <br /> d. This permit does not release the permittee from their responsibility under any other existing laws,ordinances,regulations, or <br /> statutes of other government agencies. <br /> 14. Conditions-Site Specific: <br /> a. The permittee shall store no more than 200,000 waste tires/passenger tire equivalents on site,at any given time. A waste tire <br /> includes a repairable tire,scrap tires,baled tires,and altered tires,but does not include crumb rubber(less than or equal to'/4 <br /> inch in size),tire derived product as defined in PRC Section 42805.7,or a used tire meeting the definition of PRC Section <br /> 42806.5. <br /> b. The waste tire storage shall be arranged as approved on the attached Site Plan or an amended Site Plan approved by <br /> CalRecycle in writing. <br /> c. No waste tire pile shall exceed 50 feet in width, 100 feet in length,and 12 feet in height. <br /> d. Waste tire piles shall be maintained 20 feet or more from the property line and shall be stored 20 feet or more from any other <br /> waste tire piles in accordance with the alternative requirements approved by the local fire authority. <br /> e. The requirements of 14 CCR Section 17354(h)shall not apply to this facility provided the waste tires are stored in accordance <br /> with the alternative requirements approved by the local fire authority. <br /> Page 2 of 5 <br />
