1 PLEASE TAKE FURTHER NOTICE THAT PURSUANT TO PRC SECTION 42845, <br /> 2 42850 AND 42850.1(b)(2): <br /> 3 If the above actions are not completed or complied with by the specified dates, the <br /> 4 CIWMB may petition the superior court for injunctive relief to enforce this order and for civil <br /> 5 penalties in the amount of not less than $500 and up to $10,000 per day for each violation <br /> 6 pursuant to PRC section 42845, 42850 and 42850.1(b)(2). Liability for civil penalties may be <br /> 7 imposed in a civil action or may be imposed administratively pursuant to PRC section 42850 at <br /> 8 seq. <br /> 9 Pursuant to PRC section 42846.5, CIWMB or its contractors may subsequently enter <br /> 10 your property for the purposes of abatement or remediation without your consent if such an <br /> 11 order setting liability is issued. <br /> 12 Failure to remove all of the tires by the required date may result in the CIWMB <br /> 13 expending available funds to perform any clean up, abatement, or remedial work required <br /> 14 under the circumstances set forth in PRC section 42845 at seq. <br /> 15 If the CIWMB expends funds to perform any clean up, abatement, or remedial work, the <br /> 16 CIWMB may seek cost reimbursement from the operator or property owner pursuant to PRC <br /> 17 section 42847. <br /> 18 Moreover, funds so expended by the CIWMB constitute a lien upon the real property <br /> 19 owned by any responsible party that is subject to the remedial action, pursuant to PRC section <br /> 20 42847.5. <br /> 21 Nothing in this Cleanup and Abatement Order shall constitute or be construed as a <br /> 22 satisfaction or release from liability for any conditions or claims arising as a result of past, <br /> 23 current, or future operations of the Operator and/or Property Owner Notwithstanding <br /> 24 compliance with the terms of this Order, Operator and/or Property Owner may be required to <br /> 25 take further actions as are necessary to protect public health or welfare or the environment. <br /> 26 <br /> 27 <br /> 28 <br /> -4- <br />
