Ruiz [EH]
Subject: Clean Up and Abatement Order(CAO)
Robert,
This is a standard clean up and abatement order. After the CAO is issued, an operator is given 30 days to clean up and then if he
is over that amount the CIWMB may impose fines. The CAO simply says to cease and desist above 1,500 waste tires.
I informed Eric it was coming and he is apparently shocked now that he has it. His failure to work with Terry Smith on the issue
stating that he would apply for a permit and never did, prompted the CAO.
Eric should review the Notice of Violation given to him on Jenni's initial inspection back in July 2006. This is Step 2 of the
Enforcement Process. He was inspected 3 months in a row by Jenni in which he violated tire storage standards each time.
Here is our link to the NOV Jenni gave him back in July.
http://www._ciwmb.ca.gov/Tires/Forms/Inspection/CIWM$l 84.pdf
Eric did ask for a re-inspection when I last spoke to him around the middle of December, however my management stated we
would like to inspect on our time line, not his. The compliance deadline date in the CAO is January 10, 2006. Would you like to do
a joint inspection??
Staff time is an issue when a operator wants us to come out and inspect then it's in compliance for that day. We don't want to get
into a chronic situation of in and out of compliance.
Eric did leave me a message at 5:33 p.m. last night, and I will call him back today.
Please call if you would like to discuss further.
Laura Niles,
California Integrated Waste Management Board
Tire Enforcement
916-341-6428
12/28/2006
