(EHD) inspector was on site on 5/12/2017 for
service request SR0077233 to verify functionality of four installed Bravo Conv B2000 under
dispenser containment (UDC) dispenser conversion frames. The inspector noted that all four
conversion frames did not fit the UDC sumps and seepage was observed at piping at/or above the
shear valves into the UDCs at dispensers 1-2, 3-4, and 7-8.
VIOLATIONS/OBSERVATIONS:
A violation that is causing, or threatens to cause a liquid release of petroleum from an underground storage tank system, including, but not limited to: the
failure of any required overfill prevention system, where the failure is causing or threatens to cause a release, or the failure of a required spill
containment structure, where the failure is causing or threatens to cause a release to the environment due to a spill or an overfill. CCR 2717(a)(1)
A violation that impairs the ability of an UST system to detect a liquid leak or contain a liquid release of petroleum in a manner required by law, including,
but not limited to: tampering with leak detector equipment so that the equipment is no longer capable of detecting a leak at the earliest possible
opportunity. CCR 2717(a)(2)
CORRECTIVE ACTIONS/ORDER:
All primary containment of the underground storage tank system must be tight, and dispenser
conversion frames must encompass the under dispenser containment (UDC) and redirect dispenser
primary piping leaks into the UDCs. Immediately have a properly licensed, trained, and certified
contractor repair or replace the failed component(s) and test functionality under permit and
inspection of the EHD. If not corrected immediately, there is a possibility that the facility may be red
tagged to prevent fuel inputs.
CORRECT BY: Immediately
FAILURE TO COMPLY WITH THIS NOTICE
MAY RESULT IN FORMAL ENFORCEMENT ACTION
LINDA TURKATTE, REHS
DIRECTOR
INSPECTED BY: PRINT NAME:
SIGNATURE OF REGISTERED ENVIRONMENTAL HEALTH SPECIALIST
RECEIVED BY: DATE:
SIGNATURE OF OWNER/OPERATOR
EHD 48-042 Rev. 01/26/15 NOTICE TO ABATE
