M. Swift and Associates. <br /> According to the report, soil borings were drilled 10.5 to 12 feet below grade. <br /> According to the San Joaquin County Development Title (SJCDT) , Section 9--1115.3 <br /> " A Well Permit shall be approved by the Director of the Environmental, Health <br /> Division prior to drilling any subsurface boring". <br /> The above borings were drilled without obtaining a permit from PHS/EHD. This is <br /> a violation of the above listed development title. <br /> According to PHS/EHD's Well Standards , adopted pursuant to SJCDT Section 9- <br /> 1115.6, drilling of exploration holes should be performed by a C-57 licensed <br /> contractor under the direction of a California Registered Professional Engineer, <br /> California Registered Geologist, or a California Certified Engineering Geologist. <br /> Legal action may be necessary at this time. However, to preclude any injustice <br /> to you, you are requested to appear to show cause, why legal action should not <br /> be commenced against you. An office hearing has been scheduled for June 9, 1994, <br /> at 9:00 AM to be held at PHS/EHD, 445 N. San Joaquin Avenue, Stockton, CA. <br /> A contractor's questionaire, and a copy of PHS/EHD's Site Mitigation Program <br /> Guidelines for Work Plan and Report submittal have been enclosed.
