Cesar Ruvalcaba [EH]
From: Brad Doell <bdoell@lodi.gov>
Sent: Thursday,January 31, 2019 9:05 AM
To: Cesar Ruvalcaba [EH]
Cc: Lydia Baker [EH]
Subject: RE: Aboveground Storage Tank with possible fire code violations
Thank you for the information. Based on my research I am going to insist they immediately empty the improperly used
tanks and cease use of them.
BRAD DOELL,
BATTALION CHIEF/FIRE MARSHAL
CITY OF LODI FIRE DEPARTMENT
210 W. ELM ST. LOD1, CA 95240
209.333.6739
bdoell@lodi.gov
J
O- Z
From: Cesar Ruvalcaba [EH] [mailto:cruvalcaba@sjcehd.com]
Sent: Wednesday, January 30, 2019 4:33 PM
To: Brad Doell
Cc: Lydia Baker [EH]
Subject: Aboveground Storage Tank with possible fire code violations
Chief Doell,
After one of our routine Aboveground Petroleum Storage Act (APSA) inspections and review of the Spill Prevention,
Control, &Countermeasure (SPCC) plan ,the facility at 930 E. Victor Rd in Lodi, was found to have five 12,000 gallon
aboveground storage tanks (AST) containing diesel, that at one point were underground storage tanks (UST). Per the
engineer who certified the SPCC plan the tanks have placards that identify them as USTs. Per the SPCC plan, the USTs are
to be replaced with approved ASTs by January 2020.The facility stated that they are working on getting this completed
within the next 3 to 4 months.
In doing some research, California State Fire Marshal Information Bulletin 14-005 was found, which prohibits USTs being
used as ASTs. The bulletin references Section 5704.2.7, of the California Fire Code. We would like to make you aware of
these potential fire code violations since our department does not have the authority to enforce these regulations.
The tanks are owned and operated by Valley Pacific Petroleum. The facility is a cardlock gas station and is unmanned for
the majority of the day.
If, needed, you can contact Ed Ward, Risk and Regulatory Manager with Valley Pacific
His office number is (209)461-3626, cell phone is (209) 479-9697 and his email is ed.ward@vpps.net
If there are any questions, feel free to contact me at (209) 953-6213 or cruvalcaba@sicehd.com
