November 15, 2002 SAFEWAY #2600 - SAFEWAY INC MS 6531 TAX NASC LL PO BOX 29096 I7 PHOENIX AZ 85038-9096 RE: 1987 W 11TH ST TRACY This is the final notification to remind underground storage tank owners and operators that secondary containment systems installed prior to January 1, 2001, shall be tested by January 1, 2003, and every thirty-six months thereafter [California Code of Regulations (CCR) Section 2637 (a)]. As of this date, this office has not received notification of secondary containment test scheduling or results from secondary containment testing from the above-referenced facility. Secondary containment systems installed after January 1, 2001, shall be tested upon installation, six months after installation, and every thirty-six months thereafter. In addition, this office must be notified of the test date and time 48 hours prior to performing these tests. Results will not be accepted without the proper notification. All results must be sent to this office within 30 days of the test completion. It is the responsibility of the owner/operator to have all test results submitted to this office no later than January 31, 2003. Failure to complete secondary containment testing by December 31, 2002, will result in this office revoking the facility's underground storage tank operating permit. You shall not operate an underground storage tank system without a permit [Health & Safety Code (HSC) Section 252841. If a facility owner or operator chooses to operate without an underground storage tank permit further legal will be taken. If you have an underground storage tank system in which the secondary containment cannot be tested you must replace the secondary containment system, under a permit from this office, with a system that can be tested by January 1, 2003 [CCR Section 2637 (a)(1)]. Enclosed is a list of known contractors/technicians currently performing secondary containment testing in San Joaquin County.
