(Cambria), consultant for the responsible party <br /> of the Shell branded service station located at 620 West Charter Way, Stockton, California, <br /> where an unauthorized release of petroleum hydrocarbons occurred from an underground <br /> storage tank (UST), has informed the San Joaquin County Environmental Health <br /> Department (EHD) that you have not responded to telephone calls and a request by mail for <br /> access to your property for the purpose of installing monitoring wells at your site. <br /> Additional investigation is needed to assess the lateral extent of this petroleum hydrocarbon <br /> contaminated plume and the installation of monitoring wells at your site will assist in this <br /> investigation. <br /> Under California Code of Regulations Title 23, Chapter 16, Article 11, Section 2720, a <br /> "Responsible Party" is any owner of property where an unauthorized release of a hazardous <br /> substance from a UST has occurred. Property owners of adjacent parcels who fail to grant <br /> UST responsible parties access for required investigation purposes may be required to <br /> conduct an investigation at their own expense. Off-site authority to investigate is provided <br /> in Health and Safety Code Section 25289 "In order to carry out the purposes of this <br /> chapter, any duly authorized representative of the local agency or the board has the <br /> authority [to investigate, inspect, monitor, and obtain soil and groundwater samples]...., <br /> with respect to any place where USTs are located, and...with respect to real property <br /> which is within 2,000 feet of any place where USTs are located." If you do not allow Shell <br /> access to your property to investigate the plume of contaminants originating from their <br /> unauthorized UST system release, EHD may place your site in the Local Oversight <br /> Program and direct you to investigate the extent of the contamination on your property. <br /> EHD strongly recommends you promptly provide access to Shell for Cambria to install the <br /> wells as directed by EHD and allow access for sampling on a quarterly schedule. <br />
