_ Page 3 of 3 <br /> Per your November 16, 2006 letter, we submitted the well permit applications and fees on January <br /> 8, 2007. As stated in the transmittal:letter, we are currently pursuing access to the properties <br /> located at 549, 550, and 611 Charter Way. We have not received authorized access at this time. <br /> Here's where we are at with access: <br /> 549 Charter(Delta Market) The property owner is currently having the access agreement <br /> reviewed by an attorney. Last contact was 1/8/07. 1 am waiting for a call from the attorney to further <br /> discuss access. <br /> 550 Charter(Best Western)—The property owner has received and reviewed the agreement and <br /> expected to have received the authorized document by now. We have a call into him to discuss <br /> delays and to see if we have any issues. We have not received a return call yet. <br /> 611 Charter(McDonald's)—We are in contact with McDonald's corporate office. It appears that <br /> McDonald's is willing to grant access, but has their own access agreement. Once we receive this <br /> document, I will forward to Shell for their review. <br /> I will keep actively pursuing access as best I can and will submit copies of the fully executed <br /> agreements when received. If necessary, we may need SJCEHD assistance in obtaining access. <br /> trust this meets the requirements of your letter.
