Box 1496 <br /> West Sacramento , CA 95691 <br /> Dear Howard : <br /> I have reviewed the Access Agreement from Pep Boys , which you <br /> sent me on September 29 , 1995 . My comments of the agreement are <br /> as follows . <br /> Under the Section " Matters of Agreementi° item 2 , 6th line it <br /> states : Darpetro shall not submit any soil removed from the <br /> excavation ( s ) or collected from the premises to any scientific or <br /> engineering testing without the prior written approval of Pep <br /> Boys . <br /> The purpose of the drilling of the borings and the well is to <br /> sample the soil and water . I am including a copy of the Work <br /> Plan of March 15 , 1995 which lists the type of laboratory <br /> analyses which will be performed under section " Laboratory <br /> Testing " . I believe this testing should be agreed upon in the <br /> agreement and not at a later date . <br /> In the same paragraph it states Darpetro Shall provide <br /> the opportunity for Pep Boys to obtain split- samples of all <br /> material collected . This will not be a problem provided they <br /> have a collector on site at the time the work is performed . I <br /> DO NOT believe we could keep and preserve any samples to be given <br /> to them at some later date . <br /> Item 5 1st sentence talks about interference and inconvenience to <br /> normal business operations . The drilling will take place in the <br /> parking area of the store . The drilling equipment will, take up <br /> some parking space and possibly close a driving lane in the <br /> parking lot . We will position the equipment so that normal <br /> traffic flow will continue but may be limited . Figure 1 of the <br /> attached Work Plan shows the locations of three hydropunch <br /> borings HP- 3 , HP- 4 and HP- 5 and one monitoring well BM- 12 . These <br /> sites will be marked with white paint at least 2 weeks prior to <br /> the actual drilling , as required by California Law . They should <br /> check these sites and assure us that they do not have any <br /> utilities under the marked areas . If they do not wish to check <br /> the drilling sites , they should provide us with a scaled map <br /> showing the locations of the underground utilities or pipes , <br /> j which we will use to position the wells . <br /> I <br /> Item 10 discusses the insurance requirements . our firm carries <br /> one million dollars General Liability insurance . Our insurance <br /> agent informs us the cost to increase this will be about <br />
