contractor replaced the 89 drop tube during the monitoring certification and confirmed <br />that it now provides positive shut-off of flow to the tank when the tank is filled to no <br />more than 95 percent of capacity. You were present to approve of the repair and pursuant <br />to your instructions a permit application for this repair was faxed to the EHD within 24 <br />hours. Enclosed is a copy of the corresponding work acknowledgment forms. <br />6. Alleged Violation: The UST Program Inspection Report stated, "A permit must be <br />pulled from this office for all monitoring system equipment replace (drop tube, 91 <br />sensors). Pull a permit for the replaced drop tube and 91 sump sensor by 4-23-04. <br />(Received fax copy of permit.) All other monitoring system repairs to 91 tank system <br />also require a permit from this office. Contact Dina Abate with any concerns. <br />(209.468.3468)." In the corresponding Violation checklist, a check was placed next to <br />"CCR 2661 Permit to repair UST system." <br />Response: The appropriate permit applications were submitted to EHD for all repairs at <br />this facility. <br />7. Alleged Violation: In the Violation Check list, a check was placed next to "CCR <br />2635(b)(1) Spill container." There was no further explanation of this alleged violation in <br />the Inspection Report. <br />Response: It is BP's understanding that this alleged violation relates to the 89 spill <br />bucket. The necessary repairs have been scheduled and a permit application for the <br />repair work has been submitted to your office. <br />The Inspection Report also asks that (1) the results of the monitoring certification be <br />submitted by May 22, 2004, and (2) that BP identify the operator of the facility by <br />January 1, 2005. In response to these requests, I have enclosed a copy of the monitoring <br />certification results. The designated operator of the facility will be identified prior to <br />January 1, 2005. <br />With the transmittal of this letter, it is our understanding that the above-mentioned <br />alleged violations associated with this routine inspection conducted on April 22, 2004 <br />have been resolved. If this is not correct, please contact me as soon as possible.
