CHARTER WAY, STOCKTON, SAN JOAQUIN COUNTY <br /> We have been advised by our legal counsel that it is the Board's policy not to allocate financial <br /> responsibility for site investigations and/or cleanup between jointly responsible parties. Therefore, <br /> both Independent Trucking and the property owners (represented by Mr. Welch) are required to <br /> submit the remediation work plan for the stockpiled soils at the site. The submittal deadline is <br /> 7 September 1994. Further delays will result in our recommendation that the Board take art <br /> enforcement action. Concerning the extent of waste oil contamination, after we review the results <br /> of the investigation which the property owners have agreed to conduct, additional work may be <br /> required. <br /> Section 13304 of the Porter-Cologne Water Quality Control Act allows the Board to recover <br /> reasonable expenses from responsible parties to oversee cleanup and abatement of unregulated <br /> discharges which may have adversely affected waters of the state.
