The underground storage tank <br />system shall be operated to prevent unauthorized releases. Immediately contact a properly licensed, trained, and <br />certified contractor to replace or upgrade the component under permit and inspection with the EHD. <br />This is a Class II violation. <br />314 <br />HSC 25290.1, 25290.2, 25291 Failed to have secondary containment or secondary containment not tight. <br />Fuel filters were observed outside of all under dispenser containments at the facility. The underground storage tank <br />system shall be operated to prevent unauthorized releases. Immediately contact a properly licensed, trained, and <br />certified contractor to replace or upgrade the component under permit and inspection with the EHD. <br />This is a minor violation. <br />320 <br />CCR 2635, 2637.2, 2665, 2712 Failure to comply with the installation, inspection, or record keeping of the overfill <br />prevention. <br />Owners or operators of underground storage tanks that do not meet California Code of regulations, title 23 division <br />3, chapter 16 section 2635(c)(2) shall test overfill prevention equipment once by October 13th, 2018 and every 36 <br />months thereafter; and within 30 days of the date of a repair. Test results from 9/25/18 were found on site stating <br />"could not test 91. Could not remove nipple.87 passed". The facility failed to test the 91 product UST system by the <br />OCtober 13th, 2018 deadline. Overfill prevention equipment inspection results were found on site for inspection <br />conducted on 12/19/18, 67 days late. Ensure to conduct overfill prevention equipment inspection within the time <br />frame provided by the regulation and submit test results within 30 days of performing the inspection. Ensure a 48 <br />hour notification is provided to EHD prior to conducting the inspection <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by April 13th, 2019. <br />NOTE: Due to unavailability of San Joaquin County Environmental Health department inspectors, an inspector <br />from the San Joaquin county environmental health department was not present during the entire monitoring <br />system certification conducted on 2/21/19. However the inspector was able to witness inside the under <br />dispenser containment, the submersible turbine pump sumps, and spill containers of the UST system. EHD has <br />return today 3/14/19 to complete the routine inspection and awaits the monitoring system certification results to <br />review the functionality and communication of the monitoring system. Ensure the monitoring system certification <br />is submitted to EHD within 30 days of the testing date. <br />Starting September 1, 2018, all in -office CERS help will be provided at EHD hourly rate ($152).
