(e) follow all operating procedures specified by Franchisor; <br /> ( f) immediately report to Franchisor all suspected or confirmed releases from the tanks <br /> and connected piping system, unusual operating conditions, release detection signals and <br /> environmental conditions suggesting a release may have occurred, and any spills and overfills that <br /> are not contained and cleaned up; <br /> (g) properly close the underground tanks as required by law; and, <br /> (h ) comply with all federal, state and local legal requirements relevant to the operations <br /> of the underground tanks and all amendments to any permit to operate. <br /> 4. With respect to the operation of the underground storage tank system and monitoring <br /> equipment, Franchisee hereby acknowledges and agrees: <br /> - that ARCO has provided Franchisee with training on each of the items described in <br /> the attached Monitoring and Response Plan, <br /> - that Franchisee understood the content of the training, and asked any questions <br /> necessary to facilitate his understanding, <br /> - that Franchisee indicated to ARCO at the time of training any subjects addressed by <br /> the training which Franchisee did not fully understand, and <br /> - that Franchisee received complete training and information necessary for <br /> Franchisee to fully understand the subject of operating underground storage tanks. <br /> 5. Franchisor has provided Franchisee a copy of and Franchisee agrees to maintain on the <br /> Premises the Certificate of Financial Responsibility (as required by the United States <br /> Environmental Protection Agency in Subpart H, 40 CFR, Part 280 and California Health and Safety <br /> Code, Chapter 6.7, Section 25292.2). <br /> 6. Except to the extent they conflict with, or are less rigorous than the terms of this <br /> Amendment, all of the terms and conditions of the PMPA Agreement, as previously or hereafter <br /> amended or supplemented, remain in full force. <br /> IN WITNESS WHEREOF, Franchisor and Franchisee have executed this Amendment. <br /> WITNESS: ARCO Products Company <br /> a division of AtlanticRichfieldCompany <br /> Franchisor <br /> By: <br /> MANAGER <br /> WITNESS: <br /> FRANCHISEES NAME <br /> By: <br /> DATE: <br /> 11 /91 <br />
