Hazardous Materials Release Response Plaits and Inventory[25500- <br /> 25547.8] (Chapter 6.95 added by Stats. 1985, Ch, 1167, Sec. 1) <br /> ARTICLE 1. Business and Area Plans[25500-25519] (Article I repealed and added by <br /> Stats. 2013, Ch. 419, Sec. 3) <br /> 25510. <br /> (a)Except as provided in subdivision (b), the handler or an employee, authorized <br /> representative, agent, or designee of a handler, shall, upon discovery, immediately report <br /> any release or threatened release of a hazardous material, or an actual release of a <br /> hazardous substance, as defined in Section 374.8*of the Penal Code, to the UPA, and to <br /> the office, in accordance with the regulations adopted pursuant to this section. The handler <br /> or an employee, authorized representative, agent, or designee of the handler shall provide <br /> all state, city, or county fire or public health or safety personnel and emergency response <br /> personnel with access to the handler's facilities. <br /> *Penal Code 374.8,- <br /> "(e) <br /> 74.8:"(c)For purposes of this section, "hazardous substance"means either of the following: <br /> (1)Any material that, because of its quantity, concentration, or physical or chemical <br /> characteristics,poses a significant present or potential hazard to human health and safety or <br /> to the environment if released into the environment, including, but not limited to, hazardous <br /> waste and any material that the administering agency or a handler, as defined in Chapter <br /> 6.91 (commencing with Section 25410)of Division 20 of the Health and Safety Code, has a <br /> reasonable basis for believing would be injurious to the health and safety of persons or <br /> harmful to the environment if released into the environment." <br /> Cal0ES states: <br /> "All significant spills or threatened releases of hazardous materials, including oil and <br /> radioactive materials, must be immediately reported." <br /> Respectfully Request Removal: The small leak cited did not pose a significant present or <br /> potential hazard to human health and safety, nor pose a threatened release into any navigable <br /> waterways, nor was it a significant release(estimated 118 milliliters of diesel fuel was <br /> spilled)nor was the spill significant/ofa noticeably or measurably large amount. In addition, <br /> Diesel Nuel 68476-34-6 not listed in any table as a hazardous substance or extremely <br /> hazardous substance as defined in cited Penal Code 374.8(C)(1)40CFR Pt 355 App. A and <br /> 3 <br />
