Department of Toxic SubrStances Control
Maureen F. Gorsen Director
Linda S.Adams 700 Heinz Avenue Arnold Schwarzenegger
Secretary for Berkeley, California 94710-2721 Governor
Environmental Protection
July 15, 2008 n
Lance LeBouef ✓/ f
Tesoro Corporation ✓ I
9601 McAllister Freeway. Suite 600 2000
San Antonio, Texas 78216 .4?IT'/ y
Dear Mr. LeBouef: /CcsTh'
The California Department of Toxic Substances Control (DTSC) received the
information you submitted to receive a statement th 3t the subject property is a qualified
contaminated site for the U.S. Taxpayer Relief Act Public Law 105-34 and as amended
by Public Law 106-554) on June 30, 2008. DTSC has on record your submittal form
dated February 6, 2008 and an affidavit signed by John Sherburne on June 27, 2008
attesting that the property meets the requirements of the Taxpayer Relief Act. The Site
is on the State Water Resources Control Board Ge Tracker Database as Case
#391161. The Geotracker website for this Site contains electronic copies of quarterly
groundwater monitoring reports for sampling conducted beginning in 2004.
This property is located at 2448 Kettleman Lane West (BEACON 67080) in Lodi, San
Joaquin County, California 95240. The Public Heal h Services of San Joaquin County
Environmental Health Division (SJCEHD) is overseeing the investigation and cleanup of
this Site. Results of soil and groundwater investiga ions conducted between 1985 and
1996 detected elevated concentrations of petroleum hydrocarbons, including total
petroleum hydrocarbons as gasoline (TPHg), benzene, ethylbenzene, toluene and
xylene (BTEX). Remedial actions have included soil excavation to remove petroleum-
impacted soil, from the UST pit and product line locE tions, groundwater pumping and
treating from January 1986 to late 1,988 and soil vapor extraction and treatment from
December 1989 to April 1994. Following completio i of remedial activities, the Site was
granted case closure by SJCEHD in August 1997. baseline assessment was
conducted in 2003 that found MTBE in soil and groL ndwater underlying the Site.
Subsequent groundwater monitoring through May 2 07 found MTBE in groundwater
underlying the Site. Therefore, this property meets the terms for a "qualified
contaminated site," as set forth by the Taxpayer Re ief Act. The property is an area at
or on which there has been a release, or threat of release, or disposal of a petroleum
hydrocarbon or hazardous substance.
® Printed on Recycled Paper
