Wi 11 i amson -2- 14 August 1985 <br /> and 25299.5 states: <br /> "This chapter shall not be construec to limit .or abridge - the <br /> powers and .duties granted to the State Department of�:Health <br /> Services by Chapter 6.5 (commencing with Section 25100) - and- <br /> Chapter 6.8 (commencing with Section 25300) or to the State <br /> Water Resources Control Board and each regional water quality <br /> control board by Division 7 (commencing with Section 13000) of <br /> the Water Code." . <br /> California Water Code Section 13267 states in part: <br /> "(a) . A regional board, in establishing or reviewing any water quality <br /> control plan or waste discharge requirements, or in connection <br /> with any action relating thereto or authorized by. this division, <br /> may investigate the quality of any waters of the state within <br /> its region. <br /> (b) In such an investigation, the regional board may require that <br /> any person' discharging or proposing to discharge waste within. <br /> its region or any citizen .or domicil ary, _or political agency or <br /> entity of this state discharging or proposing to discharge waste . <br /> outside of its region that could affect the quality of waters <br /> within its regionshall furnish undar -penalty of perjury, such <br /> technical or monitoring - program reports. as the. board may spec- .; <br /> ify; provided that the burden, inclu .ing costs, of such" reports . <br /> shall bear .a reasonable relationship to the need for the report.. <br /> and the benefits to be otained there rom. <br /> Pursuant to our authority under the Wate Code and Health, and, Safety Code we <br /> request that you perform the following: #. <br /> 1. Monitor all on-site wells daily at all service stations owned or .operated by' <br /> Kayo where gasoline has been determined to have been released and remove <br /> accumulated product found. <br /> 2. Obtain water samples from all ground water monitoring wells on Kayo's sites . <br /> and have them analyzed. Samples are o be taken before 30 August 1985 and <br /> results reported to the Regional Board and Local Agencies no later than 20 <br /> days after the samples. are taken. Analyses shall include: Total hydro- <br /> carbons, Benzene,. Toluene, and Xylene, <br /> 3. Submit work plans to the Regional Board and. Local Agencies for review and <br /> approval . :The work plans shall incl u e: installation of additional -'ground <br /> I� water monitoring well =s to supplement he three currently at each, site; and <br /> service station inventory records for .g saline and diesel fuels. The proposed _ <br /> wells must be sufficient to characterize the areal and vertical extent of <br /> ground water and soil contamination (o f-site wells may be required) and .may <br /> require phased drilling . The work plan" due by.. 2 September 1985, . is to <br /> include -a time schedule for phasing and completin the work. <br />
