Please be aware that it continues to be our intention to <br /> develop a 250, 000 plus square foot shopping center on our <br /> property. We anticipate construction of the center commencing <br /> as early as September 15, 1991. <br /> 2 . By giving you permission to enter our property to abandon the <br /> monitoring wells we are in no way releasing you or Conoco from <br /> your obligations for any of the contamination arising from or <br /> previously existing from your property. Our permission to <br /> enter our property is for the limited purpose of abandoning <br /> the wells and is predicated upon your representations that the <br /> existing -monitoring wells and vapor extraction system on our <br /> property are no longer demonstrating or exhibiting detectable <br /> hydrocarbon levels. <br /> Notwithstanding the above, of h drocarbon contamination still <br /> exists on our property, or current or future owners, tenants <br /> or users of our property are subjected to claims for damages, <br /> or are subject to further clean up of the property, as a <br /> result of any contamination f om your site, we expect that <br /> Ultramar will promptly undertake any and all actions necessary <br /> to properly remediate the problem until any and all <br /> contamination emanating from y ur site is re-mediated to the <br /> extent deemed acceptable by the appropriate regulatory <br /> agencies.
