STATE OF CALIFORNIA-CALIFORNIA ENVIRONMENT-4L PROTECTION AGENCY PETE WILSON.Governor <br /> STATE WATER RESOURCES CON)*mK)L BOARD ...� .,y <br /> DIVISION OF CLEAN WATER PROGRAMS <br /> 2014 T STREET.SUITE 130 <br /> 1 P.O.BOX 94.4212 <br /> SACRAMENTO,CA 94244-2120 <br /> (916) 739-4106 <br /> (916) 739-2300 FAX <br /> TO: CLAIMANTS TO THE UNDERGROUND STORAGE TANK <br /> CLEANUP FUND <br /> SUB.,ECT: UNDERGROUND STORAGE TANK CLEANUP FUND PROGRAM, COMPLIANCE <br /> WITH CORRECTIVE ACTION ORDERS AND DIRECTIVES <br /> My staff recently reviewed the regulatory agency's records for the purpose of <br /> verifying the eligibility of your claim application currently. on the <br /> Underground Storage Tank Cleanup Fund Priority List. <br /> In order to be eligible for reimbursement from the Cleanup Fund the claimant <br /> must be in compliance with (1) provisions of Chapter 6.7 of the California <br /> Health and Safety Code; (2) corrective action orders and directives; and (3) <br /> the Corrective Action Regulations (Article 11, Chapter 16, Division 3, Title <br /> 23, California Code of Regulations. <br /> Our review of the regulatory agency records determined that you are currently <br /> not in compliance with corrective action directives and therefore are not <br /> eligible. Under circumstances such as yours the regulatory agency believes <br /> that there is justification to provide you with an opportunity to come into <br /> compliance and may be issuing a revised directive and schedule. Compliance <br /> with this directive and schedule may allow the Cleanup' Fund to find you in <br /> compliance with corrective action directions and therefore eligible for <br /> reimbursement from the Cleanup Fund. <br /> You must take positive, concrete steps to come into compliance. <br /> Upon submittal of documentation of compliance with the revised directive and <br /> schedule, and the resolution on any other eligibility or priority issues, the <br /> Cleanup Fund will review your claim and determine whether a Letter of <br /> Commitment can be issued to you. <br /> Documentation must consist of (1) a copy of the regulatory agency's revised <br /> directive; a copy of the Invitation for Bid and responses (if appropriate) ; <br /> (3) a copy of the contract with the consultant chosen; and (4) copies of <br /> invoices, etc. showing that work is underway and that costs are being <br /> incurred. <br /> If such work is not bid, contracted for, and initiated within the 90 day <br /> calendar period, the Cleanup Fund will take steps to remove your claim from <br /> the Underground Storage Tank Cleanup Fund Priority List. <br /> You are reminded that the Cleanup Fund requires three bids (estimates) from <br /> qualified firms for corrective action costs to be eligible. The first $10,000 <br /> of eligible costs is exempt from the three bid requirement.
