The two boxes of universal waste(UW) lamps were left open. A UW handler shall manage lamps in a way that prevents releases of any UW or component of a UW to the environment. A UW handler shall contain any lamp in a container or package that is structurally sound, adequate to prevent breakage, and compatible with the contents of the lamp. Such a container or package shall remain closed and shall lack evidence of leakage or damage that could cause leakage under reasonably foreseeable conditions. Correct immediately by keeping the container of UW lamps closed unless adding or removing UW lamps. Minor - Notice to Comply. 84. The facility did not demonstrate when the UW lamps became a waste. Employee approximated that these UW lamps have been accumulating since January 2009. A UW handler shall accumulate UW for no longer than one year from the date the UW was generated, or was received from another UW handler. A UW handler shall be able to demonstrate the length of time that the UW has been accumulated from the date it became a waste or was received. The UW handler may make this demonstration by: (1) Placing the UW in a container and marking or labeling the container with the earliest date that any UW in the container became a waste or was received. (2) Marking or labeling the individual item of UW with the date it became a waste or was received. (3) Maintaining an inventory system on site that identifies the date the UW being accumulated became a waste or was received. (4) Maintaining an inventory system on site that identifies the earliest date that any UW in a group of items of UW or group of containers of UW became a waste or was received; (5) Placing the UW in a specific accumulation area and marking or labeling the area to identify the earliest date that any UW in the area became a waste or was received, or (6) Any other method which clearly demonstrates the length of time that the UW has been accumulated from the date it became a waste or was received. The current boxes of UW lamps on site were marked with the accumulation start date of January 2009. Employee acknowledged that the UW lamps need to be disposed within one year of the accumulation start date. Submit a copy of the disposal receipt for the UW lamps by 7-1-11. Minor - Notice to Comply. 85. The employee stated that the last disposal of UW lamps occurred when the UW lamps from the fuel dispenser canopies were changed out a couple weeks ago. I requested to view the documentation for the disposal of the UW lamps. This documentation was not available. A UW handler shall keep a record of each shipment of UW pent from the UW handler's facility to another facility. The record may take the ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122).
