In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). Failed to demonstrate the UST system is operating to prevent unauthorized release in accordance to HSC 25292.1. The is currently no line leak detection for the 87 main tank fuel line in accordance with CCR 2636(f)(2). Immediately provide line leak detection to the 87 main tank fuel line. Please be aware failure to comply may result in EHD affixing a Red Tag to the fill pipes of the UST system in seven (7) business days in accordance to HSC Section 25292.3 and CCR Section 2717-2717.7 Please be aware that this and future enforcement action is billable at the current EHD hourly rate.
