In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />The leak detector for the 87 main tank failed to detect a leak when tested. All line leak detectors shall be capable of <br />detecting a 3 -gallon per hour leak at 10 psi. Facility has failed to demonstrate the UST system is operating to prevent <br />unauthorized release in accordance to Health & Safety Code(HSC) 25292.1. There is currently no line leak detection for <br />the 87 main tank fuel line in accordance with California Code of Regulation(CCR) 2636(f)(2). Immediately provide line <br />leak detection to the 87 main tank fuel line. Please be aware that the business operators and property owner were initially <br />notified on December 21, 2012, with a Notice Of Significant Violation and possible Red Tag within seven days. The <br />business operators and property owner have not made any attempts to contact the EHD nor make corrections to the <br />violations listed on the official inspection reports dated September 4 and 28, 2012. A red tag has been affixed to the fill <br />pipe of the 87 tanks. No owner or operator of a facility may deposit or allow the deposit of petroleum into an underground <br />storage tank system that has a red tag affixed to its fill pipe. Except as otherwise provided in Section 2717.2, no person <br />shall remove, deface, alter, or otherwise tamper with a red tag so that the information contained on the tag is not legible. <br />Contact the EHD immediately to make arrangements on completing and submitting the return to compliance certification <br />form, corrective action statements for each violation, and a service request permit application to replace the failed leak <br />detector on the 87main tank, the failed diesel annular sensor, the failed 91 spill container, and for the EVR2 upgrade that <br />was performed on August 8, 2012 without the EHD's knowledge.
