Complaint Investigation Rep <br />Tri -Valley Recycling <br />During the inspection, inspectors observed a blue colored open plastic container placed <br />outside the e -waste recycling area filled with used oil bottles and waste oil filters boxes. <br />Mr. Adams said the Tri -Valley Recycling trucks are driven regularly to Kragen's for oil <br />change. He further stated that the facility for the first time changed oil on the premises <br />and stored the used oil in containers that were observed by the inspectors. Mr. Fong <br />asked Mr. Adams to obtain an EPA ID number so that the facility could use a <br />transporter to haul off the used oil that was found on the premises. Mr. Fong said that <br />he observed Tri -Valley Recycling operated multiple trucks and forklifts that generated <br />waste oil regularly. He further stated the facility required a generator EPA ID number to <br />submit to a transporter who picks up oil wastes. California Code of Regulations, title <br />22, section 66262.12 specifies that a generator shall not treat, store or dispose of, <br />transport or offer for transportation, hazardous waste without having received an <br />Identification Number. Tri -Valley Recycling failed to obtain a generator EPA ID number <br />while generating used oil regularly. This violation is added as a Class I violation in this <br />report. <br />I opened one oil filter box and found that the waste oil was on the waste filter. Used oil <br />bottles and used oil filer boxes did not have a hazardous waste label that identified the <br />contents. In addition, the used oil bottles did not have a date on which the used oil was <br />filled into each bottle. Used oil filter boxes did not have dates on which the filters <br />became waste. California Code of Regulations, title 22, section 66262.34(f) states that <br />containers accumulating used oil must be labeled with name and address of the <br />generator and the words "Used Oil", "Hazardous Waste". In addition the used oil <br />container must be labeled with the initial date of accumulation. California Code of <br />Regulations, title 22, section 66266.130 requires that containers with used oil filters be <br />labeled as "Drained Used Oil Filters" with initial date of accumulation on each container <br />of filters. The absence of labels on used oil bottles and used oil filters is now classified <br />as a class II violation in this report. <br />During the inspection, Tri -Valley Recycling employees were loading Cathode Ray Tube <br />devices (CRTs) into a truck belonging to "Diaz Trucking". Mr. Adams said Tri -Valley <br />Recycling did not dismantle CRTs because transporting whole CRTs to CRT recyclers <br />was profitable for the facility. He explained that Tri -Valley Recycling employees were <br />loading the "Diaz Trucking" truck with CRTs for transportation. He said the CRTs were <br />to be delivered to an a -waste recycler named ECS located in Santa Clara. <br />Inspectors walked to the backyard of the facility and observed two parked Tri- Valley <br />Recycling trucks. Tri -Valley Recycling trucks were smaller than the "Diaz Trucking" <br />truck. One truck was lacking an elaborate paint scheme and could be called a "white <br />enclosed truck" as described by the Folsom resident from whom Tri -Valley Recycling <br />allegedly picked up waste paint and e -waste on November 5, 2010. The other truck <br />was an enclosed white truck with an elaborate paint scheme on its side. Inspectors <br />walked inside the e -waste recycling area and did not find any paint waste. Paint waste <br />was also not found out side the premises. Therefore, the alleged violation of Tri -Valley <br />Recycling picking up paint waste, reported by the Folsom resident, could not be <br />substantiated by the DTSC inspection conducted on April 19, and 20, 2011. <br />7 of 20 <br />
