Containers (two, wash basin; one, 5-gallon bucket of oil and <br /> one, 55-gallon drum of oil) are now closed. <br /> 6. As stated in 2a. and 2b. Zinc Phosphate filter cake and Iron <br /> enriched Sulfuric Acid are not "wastes" . <br /> 7a. SWPC will comply. <br /> 7b. SWPC will comply. <br /> 7c. SWPC will comply. <br /> In summary, all of the items listed in your Report of <br /> Violations have been corrected. I believe that the only issue <br /> which has not been resolved is the classification of the Zinc <br /> Phosphate Filter Cake and the Iron Enriched Sulfuric Acid. <br /> Specifically, SWPC contends that these are useful bi-products <br /> while in the Report of Violations classifies them as Hazardous <br /> Wastes. <br /> In order to resolve this issue, SWPC is preparing a report <br /> detailing our process including how these materials are made and <br /> used. We have engaged a local Chemist to help us with the report. <br /> We project that we will have a draft report ready for your review <br /> by May 15, 1991. Please let us know if there are any specifics you <br /> wish us to cover.
