1 notice by the California Department of Health Services in 1991, <br /> 2 defendant SUMIDEN sold its pickle liquor and zinc phosphate <br /> 3 sludge to defendant J.R. SIMPLOT COMPANY for use in fertilizer. <br /> 4 Using hazardous waste or recyclable materials in fertilizer is <br /> 5 specifically prohibited by the California Health and Safety Code <br /> 6 § 25143 . 2 <br /> 7 11. Defendants violated regulations contained in Title 22 <br /> 8 of the California Code of Regulations and thus violated Section <br /> 9 25189 (b) of the California Health and Safety Code. Said <br /> 1D violations include, but are not limited to, the following: <br /> 11 11a. Violations of § 66480: Shipping hazardous <br /> 12 waste/recyclable materials off-site without hazardous waste <br /> 13 manifests; <br /> 14 llb. Violations of § 66471: Failure to make hazardous <br /> 15 waste determination for the zinc phosphate sludge and pickle <br /> 16 liquor generated from the acid treatment and zinc plating of <br /> 17 steel coils; <br /> 18 llc. Violations of § 66508 (a) : Failure to have sufficient <br /> 19 safety and emergency equipment on site; <br /> 20 11d. Violations of § 66508: Storage of hazardous waste in <br /> 21 insufficiently labeled containers. <br /> 22 12 . Defendants violated the provisions of Section 25189 of <br /> 23 the California Health and Safety Code by violating the Hazardous <br /> 24 Waste Control Act. Said violations include, but are not limited <br /> 25 to, the following: <br /> 26 12a.
