1 be confident that a judgment will be a final disposition of their <br /> 2 rights and liabilities . <br /> 3 As part of its responsibility to enforce the Hazardous <br /> 4 Waste Control Law, and pursuant to H&S Code section 25182, DTSC <br /> 5 may select its legal representative from among the district <br /> 6 attorney, the attorney general , and the city attorney to bring a <br /> 7 civil action to enforce the Hazardous Waste Control Law. 4 <br /> 8 Thus, DTSC may authorize the district attorney to bring an <br /> 9 enforcement action, and, implicitly, once authorized, the <br /> 1-0 district attorney has the authority to settle such an action. <br /> 11 This case was specifically referred to the DA by DISC. <br /> 12 By DTSC' s request for the DA to prosecute this action against the <br /> 13 Defendants, the DA obtained authority to bring this action and to <br /> 14 take steps necessary to determine the Defendants ' liability, if <br /> 15 any, relating to Sumiden ' s production and handling of Ferrorich <br /> 16 and Ferrozinc, including entering into a settlement . <br /> 17 Consequently, the DA properly prosecuted this action against the <br /> 18 Defendants . <br /> 19 C. The Judgment was within the bounds of <br /> the DA' s authority to act for the <br /> 20 People . <br /> 21 The DA has broad discretion to prosecute and settle <br /> 22 actions for which it has been given authority. Nonetheless, a <br /> 23 <br /> 24 <br /> 25 <br /> 26 4 H&S Code § 25182 specifically provides : <br /> Every civil action brought under the <br /> 27 provisions of [Chapter 6 . 5 of Division 201 at <br /> the request of [DTSC] shall be brought by the <br /> 28 city attorney, the district attorney, or the <br /> Attorney General in the name of the people of <br /> the State of California . <br /> 8 <br />
