Indeed, the Board has <br /> 4 failed to do so because the facts (as set forth in paragraphs 2a <br /> 5 through 4 of the Judgment) are consistent with the decision <br /> 6 requiring Sumiden to install acid regeneration equipment , and <br /> 7 imposing taxes, reimbursement of investigation costs, and civil <br /> 8 penalties .
