No mention is made in the letter <br /> 4 that a report of violations was issued by the county to Sumiden <br /> 5 on February 26, 1990- <br /> 6 3. on March 14, 1991, Sumiden filed its 1990 roturn <br /> ; showing no fees owed. No mention is made in the return of the <br /> 8 1990 County Report of Violations. <br /> 9 4. On May 16, 1991, the Board received a letter from <br /> 1.0 the San Joaquin County Public Health Services that county <br /> 11 disposal fees are owed for 1989 and 1990. The Board reviewed the <br /> 12 Hazardous Waste Information System which contained no record of <br /> 13 waste being manifested by Sumiden. Therefore, no action by the <br /> 14 Board appeared necessary. <br /> 15 5. On or just prior to September 25, 1992, the Board <br /> 16 learned of an enforcement action against Sumiden and contacted <br /> 17 Sumiden regarding an audit by the Board of Sumiden. The audit <br /> 16 was scheduled for September 29, 1993. <br /> 19 6. At no point in time did the Board participate in <br /> 20 the negotiation of the Stipulated Judgment, nor was the Board <br /> 21 ever contacted regarding the terms of the Stipulated Judgment, <br /> 22 nor was the Board ever asked if the fees that might be owed to <br /> 23 1 the State Board of Equalisation were in fact properly determined. <br /> 24 I declare under penalty .of perjury, under the laws of <br /> 25 the State of California, that the 'foregoingis true and correct, <br /> 26 <br /> 27 1//1 <br /> 2. <br />
