Based on your letter and information obtained during <br /> our phone conversations, it appears that the aforementioned <br /> structure is exempt from the California Underground Storage Tank <br /> law and regulations under Section 2621 (a) (8) of Chapter 16, Title <br /> 23 , Code of California Regulations . This section specifically <br /> exempts units such as the one you described. Section 2621 (a) <br /> states (in part) : <br /> 2621 . Exemptions to the Regulations <br /> " (a) The term "underground storage tank" excludes the <br /> following, except those of the following included in <br /> the definition of an underground storage tank in 40 <br /> CFR, part 280 . 12 as modified by paragraphs (b) , (c) , <br /> and (d) , of 40 CFR, part 280 .10 . . . <br /> (8) A wastewater treatment tank except a tank which is part <br /> of an underground storage tank system. " <br /> These exemptions relieve owners and operators of such units from <br /> secondary containment requirements found elsewhere in the <br /> regulations, as well as all other provisions of the State <br /> underground storage tank regulations . <br />
