Any person who generates <br /> a waste shall determine if the waste is a hazardous waste. During the inspection the facility owner was notified, the <br /> aerosol removed from the dumpster, and placed with the other good product to be used. Continue to make a <br /> hazardous waste determination for any waste generated at this facility, and manage it according the Title 22 <br /> hazardous waste regulations. This is a Class II violation. <br /> This is a Class II violation. <br /> 108 CCR 66265.53 Failed to maintain a hazardous waste contingency plan onsite and submit to required agencies. <br /> The contingency plan was not available at the time of inspection. A copy of the contingency plan and all revisions to <br /> the plan shall be maintained at the facility at all times. Immediately locate a copy of the contingency plan for the <br /> facility and submit a copy of the plan to the EHD through the California Environmental Reporting System at <br /> http://cers.calepa.ca.gov/. This is a Class II violation. <br /> This is a Class II violation. <br /> 115 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> Manifest numbers 008689911JJK, 009816889JJK, 010188571JJK, and 010189486JJK were found without a signed off <br /> copy from the destination facility. Hazardous waste generators shall retain copies of all manifests signed off by the <br /> destination facility on site for three years and have them readily available for review. If the generator did not receive a <br /> copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's <br /> waste was submitted within 35 days of the date the waste was accepted by the initial transporter, the generator shall <br /> contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If <br /> the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste <br /> was accepted by the initial transporter, the generator shall submit an Exception Report that includes a legible copy of <br /> the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste <br /> and the results of those efforts.
