TRE reviewed the manifest and the material profile. The manifest lists two (2) 55- gallon drums of CA 223, Texas waste code OUTS 8091, which was transported by Safety Kleen to Safety Kleen's facility located in Denton, Texas(see copy of the manifest enclosed in attachment B). 7. Mr. Calcaterra signed the manifest and the material profile prior to the off-site transportation of the two drums. Copies of the manifests, material profile and SK's indemnification certification were presented to Mr. Calcaterra and per Mr_ Calcaterra's request, these documents were later on the same day given to Chris Nielsen of Mayall Hurley Law Firm in Stockton, CA. 8. As was required by our scope of work, TRE conducted inspection all three basins (N 37 57 418, W 121 17 743) in order to conduct a preliminary visual assessment of the condition of the concrete liner. The flow of the materiel in these basins appear to be from the right to left as the depth of the basins are 31.2"(first basin), 21" (second basin), and 20" (third basin), hence suggesting a gravity gradient of right (East) to left (West)_ 9. TRE observed that the first two basins appeared to have some pitting and damage at their bottom layers. The third basin was observed to have significant pitting and damage on its bottom layer. TRE observed chunks of broken up and damaged concrete that were removed with the oily sludge during SK's leaning of the third basin. Exposed, soil or ft sediments Iwh_raTpeared to have been impacted by the oily figuid)beneath the third concrete basin was observed when checked with hand by TRE. 10. TRE also observed an outflow pipe in the third basin,which appeared to be situated at a low point in theme sin, suggesting that the concrete basin was designed as a simple gravity induced concrete chamber oil/water clarifier, 11. At the request of Mr. Calcaterra, TRE returned back to the site the next day (1124/04) and visually observed the basin for any evidence of desorbed oil. TRE did not observe significant amount of oily liquid that were absorbed by the absorbent pads. The absorbent pads were left in the cleaned and pumped out basins. In view of the above, in order to ensure that our client is complying with the California Health and Safety Code (CAHSC)Section 25507 and other applicable section of the CAHSC, the foregoing notification is hereby made to your attention. We are also copying the State OES, San Joaquin County Environmental Health Department, Califomia Department of Toxic Substances Control (DTSC) and the Central Valley Regional Water quality Control Board (CVRWQCB) 2
