PERMIT/SERVICES
FREEMAN & BROWN
1818 Grand Canal Boulevard
Stockton, California 95207
Re: Investigation and potential clean-up of alleged
ground contamination-site code 1163
Dear Jerry:
I am writing in response to your letter of July 23 , 1990
regarding the investigation and potential clean-up of alleged
ground contamination at the site occupied by Chase Chevrolet
Company, Inc .
As I am sure you know, Jerry, Chase Chevrolet occupies
the property, and has for a number of years, pursuant to a
lease with Auto Investment Company Associates. As such, they
are a "responsible party" for any required investigation or
clean up. That lease provides in part:
"Neither shall lessee suffer to be done in and
about said premises anything which will
violate or conflict with any law, ordinance or
regulation which is now or may be hereafter
inacted by any governmental authority or
commit or suffer any waste. "
I understand the alleged ground contamination is from
one or more underground tanks which Chase Chevrolet caused to
be placed on the property. I believe that there is no
dispute that the tank or tanks in question were either
installed by Chase Chevrolet Company or by Union Oil under a
contractual arrangement with Chase Chevrolet. Clearly, Chase
Chevrolet was the company utilizing and operating any tank or
tanks .
I 'm writing to demand that Chase Chevrolet meet the
obligations under the lease and assume the costs of
undertaking a site investigation and analysis . I agree with
