As such, they <br /> are a "responsible party" for any required investigation or <br /> clean up. That lease provides in part: <br /> "Neither shall lessee suffer to be done in and <br /> about said premises anything which will <br /> violate or conflict with any law, ordinance or <br /> regulation which is now or may be hereafter <br /> inacted by any governmental authority or <br /> commit or suffer any waste. " <br /> I understand the alleged ground contamination is from <br /> one or more underground tanks which Chase Chevrolet caused to <br /> be placed on the property. I believe that there is no <br /> dispute that the tank or tanks in question were either <br /> installed by Chase Chevrolet Company or by Union Oil under a <br /> contractual arrangement with Chase Chevrolet. Clearly, Chase <br /> Chevrolet was the company utilizing and operating any tank or <br /> tanks . <br /> I 'm writing to demand that Chase Chevrolet meet the <br /> obligations under the lease and assume the costs of <br /> undertaking a site investigation and analysis .
