I issued the Notice: half of which Huffco responded to. I had included in my Violation Notice a line that he was to submit a assessment of the Hazardous Waste to SJ County and obtain a permit from them, but I have not heard from anyone at the County if this was accomplished. Our Fire Department got what they wanted.The biggest issue I have is the need for Plans to be submitted to Building Department for the operations going on inside and Planning Department concern about the material being stored at the location, so that we don't get a repeat of this. I have several options, 1 -Is to close the Business down. 2.- fines and fees until I get compliance. 3.- Start citing the property owner and put the burden on her to get Huffco into compliance. 4. Cite property owner and Huffco from my conversations with Huffco & the property owner, it's all about money. So if we can not make contact by next week, I'm going to probably go for #1- He will more then likely try to go over my head to the Mayor's office and/or #2- Civil Penalties at around $350.00 per day; equivalent of his daily rent. Its the best way to get him to the table and make an agreement he has to live by. As we try to determine what is the best course of action, I noted that there were numerous matters on your violation list dated May 18, 2009, that needed to be addressed by Huffco. Have they addressed the issues? If not, have you taken, or do you contemplate taking any further actions against them? 1
