NO. CAD089681068 <br /> The California Department of Health Services (DHS) and the <br /> Region IX office of the U. S. Environmental Protection Agency <br /> (EPA) have reviewed the Closure Plan (CP) dated April 26, <br /> 1989 . The CP is for the inground hazardous waste storage tank <br /> at your Stockton, California facility. <br /> Pursuant to Title 22 of the California Code of Regulations, <br /> Section 67212 and the regulations adopted pursuant to the <br /> Resource Conservation and Recovery Act, 42 USC 6901 et. seq. , <br /> the Closure Plan is determined to be acceptable and is hereby <br /> approved with the enclosed modifications (Enclosure 1) . You <br /> are required to comply with the specific steps of this <br /> approved Closure Plan and Closure Plan Modifications. Please <br /> note that upon completion of closure, you and a certified <br /> registered professional engineer must certify that closure was <br /> conducted in accordance with this approved Plan. Copies of <br /> the certifications must be submitted to both DHS and the EPA. <br /> Eldorado Chemical Co. is not currently in compliance with the <br /> financial responsibility requirements of Title 22 , California <br /> Code of Regulations (CCR) , Sections 67003 and 67027 and Code <br /> of Federal Regulations, Title 40 (40 CFR) , Sections 265 . 143 <br /> and 265. 147 . ECC is subject to enforcement action for <br /> non-compliance. Approval of this Closure Plan by DHS and EPA <br /> in no way relieves ECC of the responsibility of complying with <br /> financial responsibility requirements. DHS and EPA retain the <br /> authority to initiate enforcement action at any time. <br />
