Mr. Larry McGowan <br /> Page 2 <br /> July 6, 1989 <br /> In reviewing the manifests, the Department' s <br /> inspector noted that EDCC did not have copies of the <br /> notification statements which are required to be <br /> sent to the treatment facilities that handle their <br /> F-solvent land ban restricted wastes. EDCC sends <br /> hazardous waste water to The Kiesel Company in St. <br /> Louis, Missouri for incineration. The waste water <br /> contains toluene, which is an F005 land ban <br /> restricted waste, as well as methanol, and xylene <br /> which are F003 land ban restricted wastes. The <br /> Department' s inspector did not observe notification <br /> statements with these manifested shipments. <br /> II. Schedule for Correction <br /> Violation #1 shall be corrected within 30 days by filing <br /> a completed 1988 Facility Annual Report with the <br /> Department of Health Services, Toxic Substances Control <br /> Division, P.O. Box 3000, Sacramento, CA 95812 , <br /> Attention: James J. Watkins. <br /> Violation #2 shall be corrected by sending a properly <br /> completed notification statement to the treatment <br /> facility with each shipment of land ban restricted waste. <br /> Please send written certification for violation #1, along with <br /> a signed copy of the attached certification statement, to this <br /> office as soon as the violation has been corrected. <br /> You are hereby requested to submit to the EPA within 30 days <br /> of receipt of this Report of Violation (ROV) , a letter <br /> certifying that correction of violation #2 has been achieved. <br /> Your submittal to EPA must also include, to the extent <br /> possible, photographs and/or documentation that demonstrate <br /> that the above deficiency has been rectified. You must submit <br /> the information described above to Ms. Nancy Harney, U.S . EPA, <br /> Region IX, EPA Regional Coordinator, T-2-4 , 215 Fremont <br /> Street, San Francisco, CA 94105. If you have any questions <br /> regarding 40 CFR Part 268 violations, please contact Ms. <br /> Harney at (415) 974-7481. <br /> The Department will conduct a re-inspection of E1 Dorado <br /> Chemical Company, Stockton in the future to verify compliance. <br /> The issuance of this Report of Violation and Schedule of <br /> Compliance does not preclude the Department from taking <br /> administrative, civil, or criminal action as a result of the <br /> violations noted herein. <br />
